MIKE CONLEY: Describing products liability and premises liability together; what they have in common is people exercising common sense interacting with the physical world and getting hurt. Whether with products that about things and with premises cases very often is by the places where they are, whether it's a staircase or a walkway, or some characteristic of the physical world that causes an injury.
And in handling premise cases, preparation is everything. We need to be prepared on the medical end. We need to be prepared on each witness. And the goal of preparation is to be ready to try the case to fight the fight.
Very often in premises cases or products liability cases, the only person in motion is the victim. And as a consequence of that it's very common for a victim to feel like it was my fault. And it's very common for a defendant to blame the victim for what has happened.
However, very often in a premise or products cases there are established ways of doing things that prevent accidents. Something as simple as a railing extending beyond the bottom step. It's not my job to know that as a person. It's not a client's job to know that. But it an architect's job and it is a property owner's job to know that.
